Dear Peace Officers,
As a former Board Member of the Public Employees Relations Board (PERB) and
former Director of the Department of Personnel Administration (DPA), I
wanted to let you know what kind of process we can expect as the severance
election moves forward, because we should be hearing shortly that we qualified
for the severance election.
After
they give official notice, PERB will call for an informal hearing between CAUSE
/ CSLEA and PEACE OFFICERS to take place within a few weeks. CAUSE / CSLEA
will have the opportunity to cooperate with the election process or to call for
an administrative law judge (ALJ) to make a determination of the
appropriateness of the new union based upon their arguments for or
against the creation of a peace officer only union (Bargaining Unit
22). PERB will try to facilitate a settlement regarding the creation
of a new bargaining unit and classes of employees that should be
in it and address any concerns that CAUSE / CSLEA may have about the impending
severance election.
The Governor’s office, via DPA, will also be
asked for it’s position on a Peace Officers only unit and their views are
likely to heavily influence the PERB’s final decision. We fully expect that the
Governor and his administration, which includes DPA, will support the
creation of a peace officer only unit. If CAUSE / CSLEA cooperates, PERB
could call for an election before Christmas. If CAUSE / CSLEA opposes the
creation of a peace officer only union, the ALJ involvement would add a minimum
of 90-days (and possibly a much much longer) delay to the entire
process. If , on the other hand, CSLEA were to support the new unit we
could move quickly to an election and peace officers would have their own unit without
cost or delay. CAUSE/CSLEA and PEACE OFFICERS
of California could then compete in the election and we would
have a win win solution; peace officers
would have a peace officers only unit and they could choose either union,
CAUSE/CSLEA or PEACE OFFICERS of
