Yesterday,  Wednesday, October 22, 2008, the Public Employees Relations Board (PERB) held an informal hearing at their office in Sacramento.  The purpose of the meeting was to inquire if CAUSE / CSLEA and Peace Officers of California (P.O.C.) would stipulate to moving forward quickly by holding  the severance election (which more than half of you requested) to ratify the creation of a new Peace Officer only Union, Bargaining Unit #22.

P.O.C. was willing to move forward immediately and hold an election. Unfortunately,  CAUSE / CSLEA would not stipulate to any matter before PERB because they wanted an Administrative Law Judge to make the determination as to whether an election should take place at all!  Furthermore, the soonest that CAUSE / CSLEA’s attorney, Gary Messing, stated that he could be available was January 22, 2009.  Mr. Messing is, of course, very busy defending the Safety Retirement benefits for the non-sworn membership.

It is expected that an Administrative Hearing would consist of a 10-15 day hearing and P.O.C. would prefer this to consist of contiguous hearings, but we anticipate that CAUSE / CSLEA will want to have a series of single hearings dragged out over several months to further delay the process, if they can!     

CAUSE / CSLEA has effectively delayed an election by at least 4 to 6 months already – instead of allowing your voice to be heard.  No matter how you intend to vote, you have the right to vote NOW, allowing YOU to decide your own future in a State-run election and to get all of the Peace Officers to the bargaining table immediately!

Even though PERB previously determined the majority of the Peace Officers in bargaining unit 7 (BU7) had signed petition cards to sever their relationship with the Non-Peace Officer Members, CAUSE / CSLEA committed to spend YOUR DUE$ MONEY on attorneys to keep you on a leash in a majority 60%+ non-sworn union.

CAUSE / CSLEA’s refusal to stipulate to any part of the severance petition means that the PERB will have to review every class of Peace Officer in the petition, just to make sure that they are, indeed, Peace Officers!  We fully anticipate CAUSE / CSLEA is going to argue individually that groups included in the severance petition are not really cops, or that they do not deserve to be represented by their own sworn officer bargaining unit!

What does all this mean?  It means that CAUSE / CSLEA is going to delay a vote for as long as they can, preventing a Peace Officer Only union from bargaining with the State and impacting your ability to get better pay and benefits - all in the hopes that they can find a legal way out – meaning less money in your pocket, and because CAUSE / CSLEA is afraid to allow a severance vote!

What is the difference between P.O.C. and CAUSE / CSLEAP.O.C. is committed to a democratic, transparent, Peace Officer Only bargaining unit – where the President of the union is elected and responsible to the members, and where vote records, financial stipends and expenses are available to both the union board and its members alike – which is not how CAUSE / CSLEA conducts its business. 

In fact, you may well ask, “How does CAUSE / CSLEA conduct its business?”  Well for starters, at the PERB hearing Barcelona’s personal secretary took photos of P.O.C. officers, the same intimidation tactic that they got busted for before when another CAUSE / CSLEA employee, Kobe Pizzotti, got caught by the Sac PD taking pictures of undercover officers at a P.O.C. meeting last year. 

Then, of course, there are those slight Barcelona omissions to the members and board – like the fact that President Barcelona actually fouled up the Gray Davis parity contract that other unions received and then conveniently forgot to tell anyone!  CAUSE / CSLEA had an opportunity to get YOU a contract, but they turned it down!  Ask your board member formally, in writing, and to respond in writing, about why CAUSE / CSLEA did not get a pay-parity contract under Gray Davis.  To make it easier for you, we have included the e-mail addresses of the board members we could identify as follows:

We encourage you to get quick response from your board members (in writing of course!!) before their answers start to change.  Please send us a copy of your question and your board member’s response for our PERB hearing records.  We would really love to know what the CAUSE / CSLEA board really knows.  After all, President Barcelona would have told the board that he turned down a pay-parity deal – right . . . ,  of course, . . . right???

 

CAUSE / CSLEA has already announced through its affiliates that there is no money on the table for anything this year.  What that means is that there is no better time to take a new bargaining team to the table since CAUSE / CSLEA admits there is nothing to lose right now.  This gives YOU the opportunity to send who YOU want to the bargaining table right now to represent YOU, not the non-sworn.
